There are many terms tossed about when people talk about the legality of CBD oil. News like Cannabis, hemp, THC, and Cannabis can often easily decide whether a CBD oil or other product is legally available for use and purchase or no. But why does this thing? Cannabidiol products all see and taste the same, right? Well- not quite. This article will further discuss the various types of Cannabis, which makes cannabis products legal, and where CBD legal is.
Let’s Discuss Cannabis
The value of Cannabis with a high concentration of THC for recreational purposes is banned in most countries around the world. Although, many states have used a policy of decriminalization to make simple possession a non-criminal offense. Others have much more severe penalties. For example, in some Asian countries, possession of Cannabis is legal and can result in imprisonment for several years. In most middle eastern countries, possession of tiny quantities can result in more severe punishments.
Inside the United States, for example, the legal status varies according to state. Cultivation of hemp was made officially legal on a federal level thanks to the 2018 Farm Bill. This 2018 Farm bill allowed many farmers to grow a specific type of cannabis plant used to manufacture cannabidiol products. Known as hemp-derived, the compound is generally used in the United States to make CBD oil, primarily used as a partial treatment of a variety of medical conditions.

Before we go into all that, let’s back up a little bit and speak about Cannabis and where CBD comes in. The term cannabis belongs to a genus of flowering plants from the Cannabaceae family. This family consists of three main species: Sativa, Indica, and Ruderalis. While people usually refer to hemp and Cannabis as “species,” they are not. To the As Journal of Cannabis and Cannabinoid Research3, these terms “hemp” and “cannabis” are broad groups of Cannabis adopted into everyday language by different cultures; but, they technically cannot be called plants on their own.
Now, this is the knowledge we have adopted:
- “Hemp” applies to cannabis varieties4, such as Cannabis Sativa L. containing 0.2% or less THC content. State authorities control their cultivation.
- “grass,” “pot,” “weed,” and “ganja” are synonym words, referring to Cannabis varieties that contain higher than 0.2% THC5 and can cause psychotropic or euphoric effects upon the user.
Cannabidiol is one of higher than 60 compounds6 found in the cannabis plant, which means that both “hemp” and “medical cannabis” include it within their chemical structure. This also suggests that CBD tinctures can be prepared from all cannabis plants, but the CBD to THC concentration will change with each plant.
CBD 2018 Farm Bill Legalized
Due to legislation passed at the end of 2018, hemp and its secondary products are legal in the U.S. This means that on a federal level, hemp CBD products are currently legal as excellent.
Hemp legalization began to pass due to a stock added to the 2018 Farm Bill that would completely legalize the hemp industry in the U.S. The condition, officially known as the Hemp Farming Act of 2018, was introduced by Senate Majority Leader Mitch McConnell (R-Ky.)
The law obliterated hemp from the Controlled Substances Act (CSA) and allows it to be sold as an agricultural commodity. Not just that, but the Hemp Farming Act of 2018 also provided hemp to be used commercially in the manufacturing of products. This means that all hemp products are now federally legal in the U.S., including CBD oil products obtained from hemp.
Because CBD products are now federally legal, you can carefully take them through TSA checkpoints when flying without any fear of getting in difficulty. As high as travelers have CBD products that adhere to the guidance described in the 2018 Farm Bill, the TSA will permit them on an airplane.
This change affects the only hemp. Marijuana is yet illegal on a federal level, including CBD products made of marijuana. We will include the difference between hemp and marijuana next.
Legal Differences Between Hemp and Marijuana
Hemp and marijuana do both considered types of cannabis plants. While they come from the same kind of plant, their different chemical makeup means they are regulated differently. Understanding the difference between these types of cannabis plants is essential for determining whether a CBD product is legal.
The important differentiator between hemp and marijuana in the law’s eyes is THC’s level found in the plant. THC, which is low for tetrahydrocannabinol, is the chemical found in Cannabis, especially marijuana, that gives users euphoric and psychoactive results.
For cannabis plants to be regarded hemp, it must have 0.3% THC or less by dry weight. This deficient THC level ensures that hemp is not intoxicating and cannot be utilized to induce a psychoactive or euphoric effect. While it is federally legal hemp in the U.S., the high THC levels found in marijuana make marijuana federally illegal.
CBD products originated from marijuana containing a very high THC level are but federally illegal and are considered a controlled substance under the Controlled Substances Act. Still, since medical and recreational marijuana is legal in several states, you may be ready to find CBD products with higher than 0.3% THC in marijuana dispensaries in states where marijuana is legal.
For, it is not the CBD itself or CBD products that are legal or illegal. Rather, it is the beginning of the CBD that decides if it is federally legal or not. Hemp-derived CBD is federally legal, while marijuana products that contain CBD and THC are yet federally illegal.

This Role of the U.S. Food and Drug Administration (FDA)

The goal is to have a system to ensure that all CBD products for sale are safe for consumption and feature high-quality CBD. The FDA also wants to regulate CBD manufacturers’ marketing claims, stopping distributors from making outlandish claims without evidence and data to back them up.
